1. What Information Do We Collect?

Personal information you disclose to us. We collect personal information that you voluntarily provide when you register on the Services, express interest in our products and Services, participate in activities on the Services, or contact us. This may include: names, phone numbers, email addresses, mailing addresses, billing and payment information (processed by our payment processor), and account login credentials.

Transaction information you provide. As part of coordinating your real estate transactions, you may provide us with information about the parties to those transactions (such as buyers, sellers, co-agents, lenders, title and closing companies, and inspectors), including their names, contact information, and transaction documents. You are responsible for ensuring you have any consent or authority required to provide this information and to authorize us to process it on your behalf.

Information automatically collected. We automatically collect certain information when you visit, use, or navigate the Services, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, and information about how and when you use our Services. This is primarily needed to maintain the security and operation of our Services and for internal analytics. We also collect information through cookies and similar technologies.

Sensitive information. We do not process sensitive information.

2. How Do We Process Your Information?

We process your personal information to: facilitate account creation, authentication, and management; deliver and facilitate delivery of services, including coordinating your real estate transactions and, at your direction, communicating with the parties to those transactions by email and SMS; respond to your inquiries and offer support; send you administrative, transaction-, and account-related information; send marketing and promotional communications where permitted and in accordance with your preferences (you can opt out at any time); evaluate and improve our Services; and comply with our legal obligations.

3. When and With Whom Do We Share Your Personal Information?

We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place designed to safeguard your personal information. The categories of third parties we may share personal information with include: AI Platforms, Cloud Computing and Data Storage Services, Communication and Messaging Providers (email and SMS delivery), Payment Processors, Data Analytics Services, and Website Hosting Service Providers.

We may also share your personal information in connection with a business transfer (such as a merger, sale of assets, financing, or acquisition); with our affiliates, including other brands operated by Bright LLC, who must honor this Privacy Notice; with the parties to your transactions, at your direction, in order to coordinate your deals; and where we are legally required to do so.

SMS opt-in data is never shared with third parties or affiliates for their own marketing or promotional purposes.

4. Do We Use Cookies and Other Tracking Technologies?

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some help us maintain security and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions. We may also use analytics services to understand how our Services are used. You can refuse certain cookies through your browser settings.

5. Do We Offer Artificial Intelligence-Based Products?

As part of our Services, we offer products, features, and tools powered by artificial intelligence ("AI Products"), including our AI transaction coordinator. We provide the AI Products through third-party service providers ("AI Service Providers"). Your input, output, and personal information may be shared with and processed by these AI Service Providers to enable your use of our AI Products. We contract with our AI Service Providers to protect your information and to restrict their use of it to providing services to us.

6. How Long Do We Keep Your Information?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements, or the need to retain transaction records). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or securely store it and isolate it from any further processing until deletion is possible.

7. How Do We Keep Your Information Safe?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process, including encryption in transit, access controls, and row-level security on stored data. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure. You should only access the Services within a secure environment.

8. Do We Collect Information From Minors?

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18. If we learn that personal information from users under 18 has been collected, we will deactivate the account and take reasonable measures to promptly delete such data. 9. What Are Your Privacy Rights?

Withdrawing your consent. If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time by contacting us. This will not affect the lawfulness of processing before its withdrawal.

Opting out of marketing communications. You can unsubscribe at any time by clicking the unsubscribe link in our emails, replying "STOP" to our SMS messages, or contacting us. We may still communicate with you to send service-related messages necessary for the administration and use of your account.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as platform and messaging providers, is permitted solely to deliver the Services. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Account information. To review, change, or terminate your account, contact us using the information below. Upon your request to terminate, we will deactivate or delete your account and information from our active databases, though we may retain some information to prevent fraud, troubleshoot problems, assist investigations, enforce our legal terms, and/or comply with applicable legal requirements.

10. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature you can activate. As no uniform technology standard for recognizing and implementing DNT signals has been finalized, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

11. Do United States Residents Have Specific Privacy Rights?

If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you, to correct inaccuracies, to obtain a copy of, or to delete your personal information, and to withdraw your consent. We have not sold or shared personal information to third parties for a business or commercial purpose in the preceding twelve (12) months in a manner that would require opt-out under applicable law, and we do not sell text messaging or SMS opt-in data.
